OVERVIEW OF ENDORSEMENT:  The Coalition to Save PVE, after interaction with all three candidates for PVE City Council for the March 7, 2017 election, has determined to endorse Kenneth Kao.  The choice came down to Kenny Kao or Sandy Davidson, as Jim Goodhart’s egregiously foolish behavior as a councilman knocked him out of the running at the outset.  The decision for Kao was an easy one given that the foundation of a good councilperson is one who consistently honors his/her fiduciary duties of due care and loyalty to PVE residents.  To put this in more colloquial terms, Palos Verdes Estates residents want representatives who in making decisions a) gather material, relevant and consequential information (the facts) and then b) exercise sound judgment utilizing that information (i.e., know what to do with those facts).  Kenny Kao has exhibited behavior that leads us to believe he will engage in precisely that approach.  When a question is unclear to him, Kao asks for clarification or it to be repeated.  When asked a question on a subject in which he has little experience, he modestly admits that and commits to studying the facts, rather than winging it or spouting inanities.  Click here for video evidence of these qualities.  This is the behavior of a prudent decision maker, making Kenneth Kao perhaps the most qualified, gifted candidate for PVE City Council in decades.  Therefore, he is getting our votes at the Palos Verdes Estates election on March 7th.

DUTY OF DUE CARE:  The duty of care requires a councilperson or appointed officer to make decisions after taking all available information into account, and then act in a judicious manner that promotes PVE’s best interests.   The three components scrutinized in determining if a councilperson exercised due care are did he a) fulfill his duty of care by acting in a reasonably prudent manner when making the decision, 2) conduct an adequate degree of due diligence, and 3) act in good faith.  It is this duty that most often has been violated by Tony Dahlerbruch, Sheri Repp Loadsman, Christi Hogin, Ken Rukavina, Rob Olson, and the incumbent PVE City Council.  As seen starkly in the Via Panorama parkland (click here) and Big Orange illegal cycling signage and enforcement disputes, these fiduciaries imprudently made bad decisions after conducting inadequate due diligence.  Moreover, the ample evidence uncovered by John Harbison (in discovery; click here) of attempts to cover their duty-violating tracks indicates that bad faith also played a role in the horrific outcomes of their actions.  In the case of PVE Chief of Police Jeff Kepley, his globally and embarrassingly notorious bungling of the Lunada Bay Boys conflict (click here) is one of myriad examples of Kepley’s incompetence that dishonored his duty of due care to PVE.  Breaches of due care by these fiduciaries is displayed in great detail on the PVE City Hall Wall of Shame (click here).

DUTY OF LOYALTY:  The duty of loyalty requires a councilperson or appointed officer to act at all times in the best interests of PVE.  The duty of loyalty requires a councilperson or appointed officer to be completely loyal to PVE at all times. It also imposes the responsibility to avoid possible conflicts of interest, thereby precluding a councilperson from self-dealing or taking advantage of a municipal opportunity for personal gain. Violation of the duty of loyalty may expose the councilperson to a court order to pay restitution and stiff fines. It is this duty that most often has been violated by the PVE Police Department headed by Jeff Kepley and John Eberhard.  Breaches of loyalty to PVE by these two police chiefs are displayed in great detail on the PVE Police Department Wall of Shame (click here).

PRO’S OF KENNY KAO FOR PVE CITY COUNCIL.  Kenny Kao is an energetic family (3 school-age kids) and businessman who will do his homework before making a thoughtful, well reasoned, prudent decision that he believes is in the best interest of Palos Verdes Estates.  Our endorsement of Kenny Kao comes down to that basic observation which, as you have read above, satisfies the honoring of his duties of due care and loyalty to PVE.  The Coalition bases its opinion on the following evidence:

1) Integrity:  We at the Coalition have no shortage of experience dealing with unscrupulous PVE government officials (and thus the existence of this website).  Though this is just our judgment call, our read on Kenny Kao is that he is as honest a politician as one could desire, especially at the local level. Time will tell if we got this part right.
2) Experience:  PVE Traffic Safety Committee (4 years) and  PVE Planning Committee (2 years); Sanford Davidson falls terribly short here, as seen when he was exposed as having no understanding of the federal law mandating cell phone towers in PVE (click here).
3) Intelligence:  Boalt law school and articulate speaker; Sandy Davidson falls short here as seen by his political website’s vague and at times factually incorrect content, combined his odd behavior during the February candidates forum (click here and here).
4) Independence:  Kao fought PVE deputy city manager Sheri Repp Loadsman on her disloyal plan to permit Airbnb/Short term rentals.  He also has stated publicly he is against selling parkland.  Sanford Davidson scores even higher points in this category as a clear outsider and outspoken opponent of the incumbents.
5) Loyalty:  Kao grew up in PVE, and his loyalty to his home base shines clear.  Kao’s determination not to allow PVE to be the only South Bay/Peninsula city permitting short term residential rentals (Airbnb) is Exhibit A in the case for his loyalty to PVE residents.  If not for Kenny Kao, it is the Coalition’s view that Sheri Repp Loadsman would have tricked the PVE Planning Commission into accepting her proposal to permit this heinous residential trend.   (Google “Desire Meli Kocarslan” for example of relevance to PVE).  Click here and go to around 18:00 to watch Kao hold Repp Loadsman accountable for her deceit.  Furthermore, Kenny Kao has reported that he missed not one single PVEPC meeting during his entire tenure thereon.

6) Inquisitiveness:   Young and energetic Kenny Kao is hardly indolent, exhibiting the will and skill to hunt down facts to develop a list of pro’s and con’s of any course of action.  The Coalition expects Kao to apply this method to researching a solution to rampant illegal cycling by the Big Orange Biker Gang (hint:  a new PVE police chief).  By contrast, Sandy Davidson appears more a stubborn, mature man disinterested in learning information vs. Kao being an intellectually curious man seeking out the truth.
7) Legacy PVE Club Membership:  Kao has made crystal clear he would not support wholesale changes to the PVBAC concession that would escalate membership into already-congested non-pool deck areas.  His view is that while 10+ years is a long time, such a waiting period has been residents’ expectation vs. the alternative of daily pass usage.  Kao, examining his own position in line, believes that he has waited for 3-4 years and there is no fair rationale to jump the line near those having waited nearly a decade.

CON’S OF KENNY KAO FOR PVE CITY COUNCIL.  Kenny Kao is an insider with predictably owed allegiance, based on their endorsement of him for the seat, to the very incumbents on PVE City Council who themselves have breached their duties of due care and loyalty to PVE.  This is the one clear downside of his candidacy vs. that of Sandy Davidson.  Unfortunately, only time will tell if Kenny Kao is willing and able to confront and counter the very people who helped get him elected into the seat on the dais right next to him.  Should he join the long list of PVE elected and appointed officials who regularly breach fiduciary duties to residents, rest assured that the Coalition will go after him with a level of dedication unseen before.

SANDY DAVIDSON CANDIDACY:  With two council seats up for grabs, despite our grave reservations of Davidson’s mental fortitude we strongly pray that he, and not Jim Goodhart, joins Kao on the City Counsel dais in March. The indisputably valid selling point of Davidson’s candidacy is his supreme independence from incumbent PVE government (though we worry over his rumored dependence on John Harbison and his mini-cult of followers).  Unquestionably, this is not a man who will follow his predecessors’ lead of approving anything emitting even the slightest odor of corruption or waste (except perhaps the PVEPD budget; see below).  Of concern, though, is that slow speaking Davidson has come across to members of the Coalition as neither intelligent, informed, nor seemingly very interested in becoming so by doing basic due diligence.  It thus has become the Coalition’s strong view that Sandy Davidson is a septuagenarian at the end of his accomplished medical career who, in looking for some purpose in life post-retirement, was encouraged by a growing number of discontent PVE residents to throw his confrontational hat into the local political ring.  Furthermore, based on his odd public behavior, some question his mental or emotional normalcy (click here).

Davidson’s bare bones political website (click here) exudes a mastery of truly no topic but instead spouts generalities.  One such statement sans specificity is his purported goal to “create reasonable and balanced budgets.” However, Sandy Davidson either is ignorant or doesn’t comprehend the crucial relevance to the PVE budget  of the notoriously ineffective PVEPD (click here).  Jeff Kepley’s department employs a horde of 3-day workweek, $110,000 – $210,000/year+ compensated officers (click here) whose low risk and elementary job is to drive in scenic loops around a tiny city with almost zero hard crime.  Troubling is the PVEPD’s dedication to NOT enforcing a large swath  of softer crime (PVEMC and CVC violations).  As a result of these huge sums being paid, the greater than $6.6 million PVEPD budget consumed a staggering 57% of the PVE total budget and over 99% of PVE’s property tax revenue (click here).

Also glaringly ignorant is Sandy Davidson’s platform advocacy to “enforce P.V.E. biking ordinances,” (click here), despite the fact that not a single such ordinance even exists to enforce in the first place (click here and search “bicycle”).  This damages his credibility when countering the rampant illegal cycling in PVE, allowing the biker gang to target Davidson’s ignorant statement as evidence that a PVE city councilperson demanding bicycle law enforcement has neither clue nor credibility.  Worse is the fact that he has been alerted by multiple parties to this error, but despite weeks passing has not made the simple change of  three letters to his unrefined website (“P.V.E.” to “CVC”.)

JIM GOODHART CANDIDACY:  supremely experienced with a decade of tenure on the PVE City Council, but lacking in integrity, intelligence and independence.  It is beyond obvious that it is time for Jim Goodhart to hang up his public servant shoes and be sent out to pasture.  As strongly as the Coalition endorses Kenny Kao, it renounces Jim Goodhart with even higher conviction.  Thus, any PVE resident leaning toward voting for Goodhart may want to give serious consideration to either of the alternatives.

  1. With just a weekend left to go, it’s now a safe bet that the Coalition backed the right horse. Word about town is Kenny Kao has been received very well, so let’s just say one of 2 seats is his. The 2nd seat is now up for grabs. Sandy Davidson has attracted fringe voters how are the type who voted for Trump. They just want anyone in there who isn’t like those already on the dais. Jim Goodhart is gets a ton of backslapper votes – people he’s schmoozed for 11 years or more. My $ probably is on Goodhart. Davidson most likely goes the way of Sheryl Iannitti.

    1. Fortunately, PVE voters were not bamboozled sufficiently by Tony D, the PVEPD POA and the fools who think they are noble to support them. Those disloyal fiduciaries were defeated by the obvious logic of rejecting both “Village Idiot” Jim Goodhart and PVEPD officer bank account filler Measure D. Kepley’s goose officially got cooked yesterday, and that should be the end of a 50-person PVEPD with officers driving in safe, scenic loops, only 3-days/week, and pulling up to $210,000/year for the privilege. The Coalition is taking the under on him being “gone” (resignation/retirement announcement) by 4th of July this year. Any takers?

  2. Does anyone know how this odd “comrade” Sandy Davidson got the idea to run for City Council at this point in his life cycle? Something tells me that someone or some group put him up to this. I have heard that some rabble-rouser named John Harbison did it or some “Beach Club Boys” from the PVBAC. Anyone with information please let us know.

The puzzle is solved, it seems — John Harbison uses attorney Jeff Lewis to sue PVE. Joan Davidson uses Jeff Lewis to sue PVEUSD. John Harbison is the guy behind Sandy Davidson:

      “Here’s the background on Sanford Davidson running for PVE City Council, and like many “tells” in life it’s the absence of a signal that sends up the brightest flare of them all. Davidson has a “endorsers” page on his amateurish political website that has a bunch of guys’ names on it, such as PVE provocateur Bill Patton, but not Patton’s litigation “partner” John Harbison. One of Davidson’s most outspoken platform issues is the “illegality” of the Lugliani Via Panorama Parkland sale matter — the very same matter that drove Harbison to form an entity to sue PVE. Folks, what are the odds that the candidate most vocal about the invalidity of the Parklands deal is not going to have the litigator of that suit show up as a supporter on that candidate’s endorser’s page? So, you don’t have to be Sherlock Holmes to deduce that Harbison is trying to hide the prospect that he has attached strings to Sandy Davidson’s jaws and thereby is feeding him words to utter if/when he becomes a councilman. Also pulling strings appears to be PVBAC vocal members (aka the “Beach Club Boys”) who watch Davidson make crazy statements such as that the incumbent City Council wants or plans to privatize the PVBAC. This is some kind of punishment for Jenn King having the backbone to try to improve the club’s access to more PVE residents, though she failed miserably by playing defense until the 12th hour.”

  3. You have to be out of your skull to vote for Sandy Davidson. I personally met him at one of his little meet and greet gatherings and I swear the guy was off his rocker beyond anyone’s wildest imagination.

  4. Regarding Goodhart:

    1. He attempted to sell 1.7 acres of our parkland then when the judge said “if this was legal you could sell ALL the parkland and make a lot of money” he doubled-down and appealed what could/should have been a clear win for the residents.
    2. He signed and takes “100% responsibility” (according to HIM) for the City’s Housing element which, on page 19 states we have 12 mobile homes then WORSE, it states that we have over 500 low-moderate income residents – the context is …THAT NEED HOUSING (it IS the Housing Element). Later in that report they explain that manufactured housing is great and to be encouraged. While I personally agree, in our City you cannot even have TRACT housing … it is illegal
    3. He rezoned the commercial districts to allow for Homeless Shelters WITH NO SPECIAL USE PERMITS AND NOT OTHER CONDITIONS … IT IS A DONE DEAL. If this was demanded by law they should have (a) noticed everyone within 300 feet, (b) held dozens of public hearings, (c) informed everyone of what felt they had to do and why and (d) given us the opportunity to vote to defend the City after the State attempted to sue us for specific performance (which would not happen!)
    4. He told the Southern California Association of Governments (SCAG) that Palos Verdes Estates believed in Climate Change. I can’t think of anything (a) more stupid, (b) that is more not his business, and (c) that would cause our little city to do such a stupid thing. This was criminally stupid and I resent it. Look I can remember the late 70s when it was ‘climate colding.’ Further, if Goodhart wants to do something to benefit the environment then he can do what I did – and put up a couple dozen solar panels! Not fucking talk!
    5. He had an encroachment on the City parkland in his back yard which he refused to remove until the City said they were going to sue him!
    6. He recused himself from voting on matters at the Beach Club because he is a member. Membership in the Club has nothing to do with having a conflict unless it is his intent to (for example) make his resalable membership be $100,000 while everyone else gets $10,000 (obtains private advantage that does not accrue to other members of the group!).
    7. He is an idiot who cannot thing but rather gives everything to our Corrupt (I agree) City Manager!
    8. He is a good old boy who enjoys being on the City Council – anyone that enjoys this is (a) an idiot, and (b) mentally unstable.
    Need More? He refuses to enforce the City’s Municipal Code. He refuses to enforce the CVC for bicycles. He was a part of the group that ‘selected’ John Rea to be the next Treasurer (they told Victoria that she could not run as the City Council appointed the Treasurer!) I can probably think of more – need some time to think!

  5. As someone who isn’t so young anymore, I wanted to like and vote for Sandy Davidson since he’s an ol’ guy kinda like me. I’m not 70 but not too far away. However, after watching these videos of him acting disoriented and holding up his hand awkwardly for a long time, I just can’t bring myself to vote for him. Even Jim Goodhart, who is no spring chicken himself, seems to have kept it all together better as he’s gotten older. I really can’t make a case against voting for Kao so that’s where my ballot is going.

  6. I had the chance to review this latest of Jeff Lewis’s lawsuits against a PV entity — the PVPUSD. After examining the PVPUSD’s defense per a 8/2/16 letter from defense counselor Sue Ann Salmon Evans (of law firm Dannis Woliver Kelley), it is my view that Davidson’s lawsuit is extremely lame. The Brown Act allows for the PVPUSD to “speak with legal counsel outside the public eye” — pretty much what the PVPUSD did. We’ll see if Lewis wins or loses, but rumors coming out of the his other lawsuit are that he is terrified that the tide has turned against him there and he’s not gonna get a penny from PVE.

  7. I am a long time member of the PVBAC – the Palos Verdes Beach and Athletic Club down on Paseo del Mar, and Kenny Kao for sure is getting my vote. He has made very clear that he respects the existing structure of the club and doesn’t want to make any high impact changes to the concession. I heard from someone that Sandy Davidson is trying to spread false stories that Kao is all about increasing club membership, and that is totally untrue. I think at most he might come up with a solution down the road involving slow days when its empty that the existing members fully endorse, rather than jamming something down our throats.

  8. The Coalition wishes to substantiate any unsubstantiated claims made below. We have confirmed that Joan Davidson is named as a plaintiff in a lawsuit against the PVPUSD. Please consider the other claims in the comment to be an OPINION, and not FACT, until we can substantiate them.

    Sandy Davidson’s wife and son don’t want you to know they are suing PVPUSD. Joan Davidson–who wears the pants in the family–also has threatened to sue the PTA and and our homeowners associations in the last few weeks. She sure is busy. She posts on Next Door–against its rules–about her husband’s campaign. Her son took the entire Cornerstone Elementary school directory–against PTA rules–to send a campaign email. They place signs with disregard for city laws. Davidson family apparently doesn’t think the rules apply to them. Why would we think they would follow the law once elected? I use “they” because it isn’t Sandy who is running; it is Joan.

    1. The Coalition wishes to substantiate all of those claims made above that remain unsubstantiated. Please consider unconfirmed parts in the above comment an OPINION, and not FACT, until we can substantiate one or more claims. On February 15, 2017, the Coalition confirmed the claim of Joan Davidson suing the PVPUSD by obtaining a copy of the lawsuit complaint against the PVPUSD in which Joan Davidson is named as a co-plaintiff. Also on February 15, 2017, the Coalition received an anonymous E-mail purporting to exhibit an E-mail sent by Sandy Davidson’s son campaigning to the entirety of the Cornerstone School parent directory; it would be reasonable to expect this or another affected party him/herself therefore to E-mail his own communication to this same directory, providing a link to this webpage. At approximately 11 a.m. on February 14, 2017, Cornerstone’s principal Michele Marcus, via her assistant Jan, was notified of the school-related claim but was unable to confirm its veracity. At approximately 11:38 a.m. on February 14, 2017, in order to obtain a confirmation or denial, a Coalition member called and reached Joan Davidson, who immediately hung up on the Coalition member once he introduced himself; should Joan Davidson wish to reverse her course of action, she has via CallerID the unblocked phone # to call and thereon leave a voice message, or may Email the Coalition, with her formal response to the claims made against her. The Coalition awaits more information before the claims can be authenticated.

        The Coalition has heard unconfirmed rumors and stories about the character and demeanor of Joan Davidson (just this morning, “She’s a real piece of work”), but did not follow up as it is her husband who by title is running for Council. Just a Google search on Joan Davidson (click here) is a bit unsettling.

        We encourage all parties with knowledge of this purported lawsuit against the PVPUSD, and any Davidson breaches to website user agreements or other evidence of his character/background, to please E-mail with supporting documentation attached. The sender’s identity shall be protected as anonymous unless directed otherwise.

    2. You could either go on the downtown LA courthouse website and find the bogus lawsuit there, or file a public records request with Superintendent Donald Austin or the PVPUSD lawyers via email. Both are quick and easy! His assistant won’t know anything, they never do, and the Cornerstone PTA should explain that one if the principal’s secretary won’t.

I believe the PVE “paths” are deed restricted or ‘protected.’ At least they have always been treated as this – consider the Torrance Boundary Trail (between PVE and Torrance) where the City recently required the home owners to remove all of their encroachments – including Jim Goodhart who, at first, did not want to do it!

  10. Is this weirdo Sandy Davidson kidding or serious? He is like 70 years old vs. Kao in mid-40s, and he thinks he’s really making some big sacrifice with his pledge never to run for higher office during his lifetime? Wow, Dr. D, you really are giving up soooooooooooooo much upside in your political career given that life expectancy for a man in the USA is 79 years. Kao is barely [past] half way to that point and if he does a great job in PVE, why shouldn’t he be eligible for bigger and better things with his talents?

  11. John Harbison Demanding John Rea Step Down as Councilperson for Ethics Violation on February 1st?

    “It has come to my attention that PVE City Councilmember John Rea is a partner in the law firm which represents co-defendant Palos Verdes Homes Association in the CEPC (Panorama Parklands) case. In the closed session on November 10, 2015 at which the City Council voted to pursue an appeal, John Rea did not recuse himself and voted in the affirmative to approve the appeal. This would appear to be a direct conflict, since his law firm is being paid substantial sums to continue the case on appeal; if the City of PVE had not voted to appeal, it may have caused the other defendants to withdraw thus doing harm to his law firm. For screenshots and links to the evidence in this matter, click here. Councilmember Rea spoke multiple times on the record in City Council meetings about this case and never disclosed to the public that he was a partner in the firm being paid by the Palos Verdes Homes Association. Several of his colleagues on the City Council are also lawyers and would know that he works for that firm, so to some extent their behavior (and that of the City Attorney as well) in the matter is also suspect by not calling out the obvious conflict of interest. Councilmember Rea is concluding his term this spring, but is running currently for Palos Verdes Estates City Treasurer in the election that will be held on March 7.”

  12. Davidson is delusional (seems to be a thing among Davidson’s in PV). The man clearly isn’t all there. Why would anyone ask someone to “swear” not to have any ambition beyond a city council?? Quite frankly he seems off his rocker.

  13. I was not aware that Kenneth Kao had made that public statement about being opposed to selling parkland. I like that when asked by the Woman’s Voter League he didn’t mince words. He just answered “No” and that was the end of it. I was deciding between Davidson and Kao because I liked Davidson being so opposed to parkland sales, but now that I know you get that with Kao I’ve made up my mind.

I wish I could vote for two candidates and make on him and the other Kao because you know for sure Davidson isn’t going to let Tony Dahlerbruch get away with anymore bad management of the city. Kao is great though so I don’t know which way to vote. It would be horrible if I voted for Davidson and lots others did too and then it’s Goodhart and Davidson who win and not Kao and Davidson.

  15. Wanna know what is an even bigger joke about Sandy Davidson? He’s got this list of supporters ( and noticeably absent is the one guy who has the most to gain from Davidson winning – JOHN HARBISON. Who does Harbison think he’s kidding by not being on Davidson’s supporter list when it’s obvious he and that ol’ RPV clown Bill Patton are behind his candidacy?

  16. Sandy Davidson Pledge Disrespects Women!

    I watched Sandy Davidson’s horrific performance 3 times in utter disbelief! What is he trying to hide?!?

    Instead of addressing the issues he rants on about a NONSENSE pledge that has nothing to do with the interests of the People of PVE. Even after being repeatedly asked by the League of Women Voters to address the issues Sandy Davidson continues to rant on and on.

    Obviously Sandy Davidson believes that a controlling demeanor and good hair (even if it’s a toupee that hides his age) is what We the People of PVE need in our leaders.

    YES for KENNY KAO!
    NO for Sandy Davidson (…and his toupee too!)
